Privacy Policy

1. Overview

GigsPool, Inc. ("GigsPool", "we", "our", or "us") operates the GigsPool marketplace platform. This Privacy Policy explains how we collect, use, disclose, and safeguard your personal information when you visit or use our website and services (the "Platform"). By using the Platform, you consent to the practices described in this policy.

2. Information We Collect

We collect information you provide directly to us, such as when you create an account, complete your talent profile, make a booking, or contact support. This includes: name, email address, profile photo, professional biography, portfolio content, payment and payout details (processed by Stripe — we do not store full card numbers), calendar availability, and communications with other users. We also collect information automatically when you use the Platform, including IP address, browser type, device identifiers, pages visited, and session duration, via server logs and our analytics provider (Umami, which is privacy-focused and does not use cookies or collect personally identifiable information).

3. How We Use Your Information

We use the information we collect to: operate and improve the Platform; process bookings and payments; verify Talent identities and credentials; send transactional emails (booking confirmations, receipts, dispute updates) via Resend; provide customer support; detect and prevent fraud or abuse; comply with legal obligations; and send product updates or marketing communications (you may opt out at any time). We do not sell your personal information to third parties.

4. Information Sharing

We share your information only in the following circumstances: (a) with Talent or Clients as necessary to facilitate a booking (e.g., your name and booking details are shared between the relevant parties); (b) with service providers who assist us in operating the Platform (Stripe for payments, Resend for email, UploadThing for file storage, Vercel for hosting) — these providers are contractually bound to use your data only to provide services to us; (c) if required by law, court order, or governmental authority; (d) in connection with a merger, acquisition, or sale of assets, in which case you will be notified via email or prominent notice on the Platform. We do not share your data with advertisers.

5. Cookies and Tracking

GigsPool uses session cookies strictly necessary to authenticate you and maintain your logged-in state. We do not use third-party advertising cookies or tracking pixels. Our analytics tool (Umami) is self-hosted and cookie-free. You can disable cookies in your browser settings, but doing so will prevent you from logging in to the Platform.

6. Data Retention

We retain your account information for as long as your account is active or as needed to provide our services. If you delete your account, we will delete or anonymize your personal information within 30 days, except where we are required to retain it for legal or compliance purposes (e.g., payment records, which we retain for 7 years as required by financial regulations).

7. Security

We implement industry-standard security measures to protect your personal information, including TLS encryption in transit, hashed passwords, role-based access controls, and regular security reviews. However, no method of transmission over the Internet is 100% secure. You are responsible for maintaining the security of your account credentials.

8. Your Rights

Depending on your location, you may have rights regarding your personal data, including the right to access, correct, or delete your information; the right to object to or restrict processing; and the right to data portability. To exercise any of these rights, contact us at privacy@gigspool.com. We will respond within 30 days. If you are located in the European Economic Area, you also have the right to lodge a complaint with your local data protection authority.

9. Children's Privacy

The Platform is not directed at individuals under the age of 18. We do not knowingly collect personal information from children. If we become aware that we have collected personal information from a child under 18 without parental consent, we will take steps to delete that information promptly.

10. Third-Party Links

The Platform may contain links to third-party websites or services. This Privacy Policy does not apply to those third parties, and we are not responsible for their privacy practices. We encourage you to review the privacy policies of any third-party sites you visit.

11. International Transfers

GigsPool is based in the United States. If you access the Platform from outside the United States, your information may be transferred to, stored, and processed in the United States. By using the Platform, you consent to the transfer of your information to the United States, which may have different data protection rules than your country.

12. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of material changes by posting the updated policy on the Platform with a new effective date and, where required by law, by sending an email to your registered address. Your continued use of the Platform after the effective date of changes constitutes your acceptance of the revised policy.
